These Terms of Service govern your use of this website and the enquiry and booking service provided by Elyxta. By using the site, you agree to these Terms.

1. Our role as a marketplace

Elyxta is an online marketplace that connects you with independent, licensed local operators. The experiences are provided by those operators, who are solely responsible for delivering the activity, for safety, and for their own booking conditions. Any contract for an activity is made directly between you and the operator; we act only as an intermediary that helps you enquire and book.

2. Enquiries, bookings and prices

Prices shown on the site are indicative and are set by the operators. The final price, availability and conditions are confirmed by the operator before your booking is complete. You can send enquiries through our contact form or via WhatsApp. Payment is made to the operator — on site or online — according to the methods they accept.

3. Cancellations, changes and refunds

Unless stated otherwise on the experience page, free cancellation is typically available up to 24 hours before the activity. If an activity is cancelled for weather or safety reasons, the operator will offer a reschedule or a full refund. Refunds are processed by the operator under their own policy.

4. Safety and your responsibilities

Water-sports activities carry inherent risks. You must follow the operator's safety briefing and instructions at all times; give accurate information about your health and any relevant conditions; and meet any age, health, swimming-ability or licence requirements stated for the activity. You must not take part while under the influence of alcohol or drugs.

5. Liability

To the fullest extent permitted by law, Elyxta is not liable for the acts, omissions or performance of the independent operators, nor for any indirect or consequential loss. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

6. Intellectual property

The content, branding and layout of this site are owned by Elyxta or its licensors and may not be copied, reproduced or reused without our permission.

7. Acceptable use

You agree to use the site lawfully; not to disrupt or attempt to gain unauthorised access to it; not to misuse the enquiry service; and not to submit false, unlawful or infringing content.

8. Governing law

These Terms are governed by Spanish law, and the courts of Spain have jurisdiction. This does not affect any mandatory consumer-protection rights you have under the law of your country of residence.
